Smoker loses hair, legal fights
A man who blamed his hair loss on the smoking-cessation drug Zyban has been ordered to pay his lawyers’ bills.
Vladimir N. Cherny of Halifax lost his hair, lost his case against GlaxoSmithKline Inc. and lost again when he turned on his lawyers and refused to pay his legal bills, according to a decision released by the Nova Scotia small claims court on Wednesday.
Adjudicator Eric K. Slone ruled in favour of the lawyers, who steered the complex case through the courts, and ordered Mr. Cherny to pay his bills, despite his hair loss and unsuccessful attempt to sue the drug giant.
"I am not unsympathetic to the rough ride that this man has had through the medical and legal systems, but the bottom line for this court is that he has retained professional lawyers to assist him and he is responsible to pay their reasonable fees," Mr. Sloane said in his decision.
